**ChatNutrition – Terms of Service**

These Terms of Service (“Terms”) govern your access to and use of the ChatNutrition mobile application (“ChatNutrition,” “the App”) operated by Claredat LLC (“we,” “us,” or “our”). By creating an account, accessing, or using ChatNutrition, you agree to be bound by these Terms. If you do not agree, do not use the App.
Your license to use ChatNutrition is also subject to the Apple Media Services Terms and Conditions and the standard Licensed Application End User License Agreement (EULA) provided by Apple. In the event of a conflict between our Terms and Apple’s EULA, Apple’s EULA will control.
1. Overview
ChatNutrition is an AI-powered food-logging and nutrition guidance application. The App allows you to log meals, receive estimated nutrition information, view personalized macro goals, and chat with an AI assistant. ChatNutrition does not provide medical or dietetic advice.
2. Eligibility
To use ChatNutrition, you must be at least 13 years old (or the minimum digital consent age in your region), have the legal capacity to enter into a contract, and not be prohibited from using the App under applicable laws.
3. Account Registration
To access full features, you must create an account using email-based passwordless login provided through Supabase. You are responsible for maintaining accurate account information and for all activity under your account. We may suspend or terminate accounts for misuse, fraud, or breach of these Terms.
4. Subscriptions, Free Trials & Billing
4.1 Subscription: ChatNutrition offers an auto-renewing monthly or annual subscription after a 7-day free trial.
4.2 Billing: Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before renewal. Renewal charges occur within 24 hours before the period ends. You can manage or cancel through your Apple ID settings. Refunds are handled by Apple.
4.3 Price Changes: We may adjust prices for new subscribers; current subscribers retain their price as long as their subscription remains active.
4.4 Free Trial: If not canceled before the trial ends, the subscription automatically converts to a paid plan.
5. Use of the App
You agree not to misuse the App, reverse engineer it, attempt unauthorized access, or use it for illegal, harmful, or inappropriate content. You may not use the App for medical diagnosis or emergency guidance. We may suspend access for violations.
6. AI-Generated Information
ChatNutrition uses AI to process entries and produce nutritional estimates. AI responses may be inaccurate or incomplete. Nutritional values are estimates only. You should independently verify information. You use AI-generated content at your own risk, and we make no warranties regarding its accuracy.
7. Not Medical Advice
ChatNutrition does not provide medical advice, diagnosis, treatment, or professional dietetic services. Always consult a licensed healthcare professional before making dietary or health decisions. Do not use the App for emergencies.
8. Privacy and Data
Your use of the App is governed by our Privacy Policy. By using ChatNutrition, you consent to its data collection and processing practices, including data storage through our third-party provider.
9. Data Storage & Deletion
Your account data—including logs, messages, and settings—is stored in secure databases through a third-party provider. You may request deletion of your account and associated data by contacting [INFO AT CLAREDATAI DOT COM]. Once deleted, personal data cannot be restored.
10. Intellectual Property
All content, design elements, software, and intellectual property within ChatNutrition belong to Claredat LLC. You may not copy, modify, distribute, or create derivative works of the App.
11. Third-Party Services
The App relies on third-party services including LLM providers. By using the App, you agree to any applicable third-party terms.
12. Disclaimer of Warranties
ChatNutrition is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted operation, accuracy, or error-free performance. You use the App at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, Claredat LLC is not liable for indirect, incidental, special, consequential, or punitive damages; health or dietary decisions made using the App; loss of data; or inaccuracies in AI-generated content. Our total liability shall not exceed the subscription fees paid in the last three months.
14. Termination
We may suspend or terminate your account for violations of these Terms, fraudulent activity, or security concerns. You may stop using the App at any time. Termination does not entitle you to a refund.
15. Changes to These Terms
We may update these Terms periodically. The “Last Updated” date will reflect changes. Continued use of the App after updates constitutes acceptance of the new Terms.
